The Gist
We run an e-commerce website at JadoPado.com and would love for you to use it. Our service is absolutely free. It is designed to give you the best experience possible, and to ensure that anything that you order gets to you on-time and quickly. Right now, we deliver across the city of Dubai in the United Arab Emirates. We hope to expand our delivery services to other cities and then eventually across the Middle East.

(We used the Terms of Service that the great team over at Automattic, the creators of Wordpress made available under a Creative Commons Sharealike license, and we've customised it for our own use, including having it reviewed by a great law firm! Keeping with the spirit of Creative Commons we have decided to make our Terms of Service available under a Creative Commons Sharealike license too, which means you’re more than welcome to steal it and repurpose it for your own use, just make sure to replace references to us with ones to you, and if you want we would definitely appreciate a link to JadoPado.com somewhere on your site.)

The following terms and conditions govern all use of the JadoPado.com website, its content, services and all products available at or through the website (taken together, the "Website"). The Website is owned and operated by JadoPado Ltd. (“JadoPado”) a company formed under the laws of the British Virgin Islands. The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, JadoPado’s Privacy Policy) and procedures that may be published from time to time on this site by JadoPado (collectively, the “Agreement”).

Terms of Service. Please read this Agreement carefully before accessing or using the Website. By accessing or using any part of the Website, you agree to become bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you may not access the Website or use any services. If these terms and conditions are considered an offer by JadoPado, acceptance is expressly limited to these terms.

The Website is available only to individuals who are at least 18 years old.

Your JadoPado.com Account
If you create an account on the Website, you are responsible for maintaining the security of your account, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the account. You must immediately notify JadoPado of any unauthorised uses of your account or any other breaches of security. JadoPado will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

Payment
You can pay by credit card, debit card or cash. Unfortunately we do not accept cheques at this time.

Orders & Deliveries
JadoPado strives to provide it’s customers with an efficient and easy to use order and delivery service.

JadoPado avoids selling any products that are not available in directly accessible inventory.

To assist it’s customers, JadoPado tries to provide accurate stock information on it’s website, however this information is a guide and may not be relied on for order confirmation.

Customers are provided with an option of picking from multiple delivery slots across three (3) days including the current day. On occasion some delivery slots may not be available if their cut off time has passed or if the delivery slot has been filled with other orders. While we try very hard to ensure that all deliveries take place on time, unfortunately elements such as traffic, weather and on occasion, fulfilment delays may contribute to delays in delivery.

JadoPado delivers across the UAE. This includes Dubai, Abu Dhabi, Al Ain, Sharjah, Ajman, Um Al Quwain, Ras Al Khaimah and Fujairah! City limits apply, which means that unfortunately we can't get out to your oil rig, dates plantation, military base or any other top secret locations. We're also unable to deliver to areas that are under customs regulations including Jebel Ali Free Zone, Dubai Airport Free Zone, SAIF Zone and so on.

JadoPado will bill your credit card as soon as you place an order with us. We carry this out to ensure that we can deliver at your chosen delivery time. If on occasion a product may be unavailable after processing your order and billing your credit card we will provide you with an option to consider selecting an alternative product or opting for a refund should we be unable to determine when the product you want may be back in stock. It may take up to [15] days for a refund to be credited back to your card.

Returns
We really hope that you're happy with your purchase!

If you should change your mind, and wish to return anything that you have bought from JadoPado, we'll be happy to refund or exchange a product providing it's returned within its specified return period, it is in fully re-saleable condition and returned in its original an undamaged packaging.

JadoPado has a general 60 day return policy (15 days for Electronics or IT products) for most items, however specific return periods might apply for certain types of items. Some items may not be returned unless there is a problem with their quality.

Unfortunately, unless there is a problem with the quality of the products or they are not as described, we're unable to offer a refund or exchange on perishables (food, health and beauty products).

If the product returned is not in fully re-saleable condition or the packaging is damaged, we reserve the right to refuse a refund on the item, or deduct up to 15% of the original selling price from the refund amount.

Refunds can only be made to the original card of purchase. It may take up to 15 days for a refund to be credited back to your card.

Conducting a return requires contacting us through our returns form located over at help.jadopado.com. Once we have your details, our deliveries team will schedule for someone to pick up the items that you wish to return.

Warranties
We hope that your purchase does not cause you any problems.

JadoPado does not expressly provide a warranty for the products that it sells. Warranties are only provided by the manufacturer of the product, if applicable. However, if a product is not functioning at the time of purchase we will endeavour to replace it as soon as possible or offer you a full refund.

In most cases JadoPado source’s it’s products directly or indirectly through authorised distributors. However from time to time, JadoPado may import products directly from other markets or sell products that have been imported by others that may not be supported by local distributors.

An imported product may not covered by a warranty that is supported by local distributors. JadoPado will however endeavour to assist it’s customers in obtaining support for their product should they be faced with a problem within 365 days of their purchase. This may include direct telephone support amongst other measures.

Responsibility of Website Visitor
The Website may contain content containing technical inaccuracies, typographical mistakes, and other errors. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. JadoPado disclaims any responsibility for any harm resulting from the use by visitors of the Website.

Content Posted on Other Websites
We have not reviewed, and cannot review, all of the material, including computer software, made available through the websites and webpages to which JadoPado.com links, and that link to JadoPado.com. JadoPado does not have any control over those non-JadoPado websites and webpages, and is not responsible for their contents or their use. By linking to a non-JadoPado website or webpage, JadoPado does not represent or imply that it endorses such website or webpage. JadoPado disclaims any responsibility for any harm resulting from your use of non-JadoPado websites and webpages.

Your privacy is extremely important to us. We won't ask you for personal information unless we truly need it. (When we do ask for your information it is usually to ensure that we're dealing with real people and not a bot!). We don’t share your personal information with anyone except to comply with the law, develop our products, or protect our rights.

Website Visitors
Like most website operators, JadoPado collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. JadoPado’s purpose in collecting non-personally identifying information is to better understand how JadoPado’s visitors use its website. From time to time, JadoPado may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website.

JadoPado also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged in users. JadoPado only discloses logged in user IP addresses under the same circumstances that it uses and discloses personally-identifying information as described below.

Gathering of Personally-Identifying Information
Certain visitors to JadoPado’s websites choose to interact with JadoPado in ways that require JadoPado to gather personally-identifying information. JadoPado may display this information publicly or provide it to others. However, JadoPado does not disclose personally-identifying information other than as described below.

A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. JadoPado uses cookies to help JadoPado identify and track visitors, their usage of JadoPado's website, and their website access preferences. JadoPado visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using JadoPado’s website, with the drawback that certain features of JadoPado’s website may not function properly without the aid of cookies.

Ads
Ads appearing on any of our websites may be delivered to users by advertising partners, who may set cookies. These cookies allow the ad server to recognise your computer each time they send you an online advertisement to compile information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This Privacy Policy covers the use of cookies by JadoPado and does not cover the use of cookies by any advertisers.

Copyright Infringement
As JadoPado asks others to respect its intellectual property rights, it respects the intellectual property rights of others. If you believe that material located on or linked to by JadoPado.com violates your copyright, you are encouraged to notify JadoPado. JadoPado will respond to all such notices, which may include as required or appropriate removing the infringing material or disabling all links to the infringing material. In the case of a visitor who may infringe or repeatedly infringes the copyrights or other intellectual property rights of JadoPado or others, JadoPado may, in its discretion, terminate or deny access to and use of the Website. In the case of such termination, JadoPado will have no obligation to provide a refund of any amounts previously paid to JadoPado.

Intellectual Property
This Agreement does not transfer from JadoPado to you any JadoPado or third party intellectual property, and all rights, title and interest in and to such property will remain (as between the parties) solely with JadoPado. JadoPado, JadoPado.com, the JadoPado.com logo, and all other trademarks, service marks, graphics and logos used in connection with JadoPado.com, or the Website are trademarks of JadoPado.

Other trademarks, service marks, graphics and logos used in connection with the Website may be the trademarks of other third parties. Your use of the Website grants you no right or license to reproduce or otherwise use any JadoPado or third-party trademarks.

Changes
JadoPado reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Website following the posting of any changes to this Agreement constitutes acceptance of those changes. JadoPado may also, in the future, offer new services and/or features through the Website (including the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this Agreement, as may be amended from time to time.

Termination
JadoPado may terminate your access to all or any part of the Website at any time, with or without cause, with or without notice. If you wish to terminate this Agreement or your JadoPado.com account (if you have one), you may simply discontinue using the Website. In addition, JadoPado can terminate the Website immediately as part of a general shut down of our service. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Disclaimer of Warranties
The Website is provided “as is”. JadoPado and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither JadoPado nor its suppliers and licensors, makes any warranty that the Website will be error free or that access thereto will be continuous or uninterrupted.

Limitation of Liability
In no event will JadoPado, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement or substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to JadoPado under this agreement during the twelve (12) month period prior to the cause of action. JadoPado shall have no liability for any failure or delay due to matters beyond our reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

General Representation and Warranty
You represent and warrant that your use of the Website will be in strict accordance with the JadoPado Privacy Policy, with this Agreement and with all applicable laws and regulations.

Indemnification
You agree to indemnify and hold harmless JadoPado, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Website, including but not limited to your violation of this Agreement.

Governing Law
Except to the extent applicable law, if any, provides otherwise, this Agreement, any access to or use of the Website will be governed by the laws of Dubai and the United Arab Emirates applicable therein.
